House Ways & Means Committee Advances Repeal of 2026 Gambling Tax Change

The House Ways & Means Committee approved the bipartisan FULL HOUSE Act in a 38-5 vote. The bill would restore the ability to deduct 100% of gambling losses after poker players and lawmakers challenged the current rule.

The House Ways & Means Committee has advanced legislation to repeal a provision that limits gamblers to deducting 90% of their losses from taxable income, potentially leaving people owing tax after a losing year.

The bipartisan FULL HOUSE Act, HR 6985, passed the committee 38-5. Five Democrats voted against the measure. The provision was included in the One Big Beautiful Bill, which took effect on Jan. 1.

“At a time of economic uncertainty, my job is to protect Nevadans and their jobs,” bill sponsor Rep. Steven Horsford (R-NV) said.

“From dealers and housekeepers to restaurant workers and small business owners, families across our state depend on visitors choosing Nevada. This unfair tax puts their livelihoods at risk. That’s why I fought to advance my FULL HOUSE Act, and I won’t stop until we get this relief signed into law.”

Senate Measure Also Targets the Provision

The bill will now go to a vote in the full House. If approved, it would move to the Senate.

Sen. Dina Titus (D-NV) has pursued a similar repeal through the FAIR BET Act over the past year. She attached that measure to a tax package this week and welcomed the committee’s action.

“Finally, after 14 months of uncertainty, my fix to restore the 100% tax deduction for gambling losses has been passed out of committee,” Titus posted on X/Twitter.

Titus said she was the first member of Congress to identify the issue when she introduced legislation on July 7, 2025. She added that she had since raised the matter nationally and with colleagues, including members of @WaysandMeansGOP.

“Now it is time for us to push this commonsense solution to the House floor, to the Senate, and finally to the President’s desk. I won’t stop fighting until we get this over the finish line,” she wrote.

Poker Players Criticise Current Rules

High-stakes poker players highlighted the tax provision while lawmakers considered the Big Beautiful Bill in 2025. Poker Hall of Famer Erik Seidel said in April that he was reducing his playing schedule because of the change.

Poker Hall of Famer Josh Arieh questioned why five representatives opposed the repeal.

“Imagine being ignorant enough to vote ‘no’ on this … there are 5 elected officials to do exactly this,” he posted on X/Twitter.

Eight-time World Series of Poker bracelet winner Daniel Negreanu also criticised the vote. He argued that the rule could create a tax bill for a player who finished even overall, using a $1,000 losing bet followed by a $1,000 winning bet as an example.

Further obstacles remain. Titus’s legislation was removed from a defense spending bill in September 2025, and lawmakers rejected an attempt to add it to a spending bill in January.
